1. Introduction

Welcome to Big Foot Forward LLC. These Terms of Service ("Terms") govern your use of my website and services. By accessing or using my services, you agree to be bound by these Terms.

2. Services

Big Foot Forward LLC provides web development, mobile app development, custom software solutions, and business consulting services. The specific details of the services to be provided will be outlined in a separate agreement or statement of work.

3. Client Responsibilities

As a client, you are responsible for:

• Providing accurate and complete information as required for the provision of services.
• Reviewing and providing feedback on deliverables in a timely manner.
• Making payments as agreed upon in the service agreement.
• Ensuring that you have the necessary rights to any content or materials you provide to me.

4. Intellectual Property

Unless otherwise specified in a separate agreement:

• I retain ownership of all intellectual property rights in the services and deliverables until full payment is received.
• Upon full payment, you will receive a non-exclusive license to use the deliverables for the intended purpose.
• Any pre-existing intellectual property used in the provision of services remains the property of its respective owner.

5. Payment Terms

Payment terms will be specified in the service agreement or statement of work. Unless otherwise agreed:

• Invoices are due upon receipt.
• Late payments may incur additional fees.
• I reserve the right to suspend services if payments are not made as agreed.

6. Limitation of Liability

To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use my services.
• Any unauthorized access to or use of my servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from my services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through my services.

7. Termination

Either party may terminate the service agreement as specified in the agreement. Upon termination:

• You will be required to pay for all services rendered up to the date of termination.
• I will provide you with all completed deliverables for which payment has been received.
• Any confidentiality obligations will survive termination.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of Washington, without regard to its conflict of law provisions.

9. Changes to Terms

I reserve the right to modify these Terms at any time. I will provide notice of any significant changes. Your continued use of my services after such modifications will constitute your acknowledgment of the modified Terms.
